The Facts: Systemic Failure

Between April 10, 2023, and April 25, 2023, Valicor Environmental Services experienced a total breakdown of its primary pollution control system. An explosion within the capture and control system forced a shutdown of the Regenerative Thermal Oxidizer (RTO).

During the RTO shutdown, zero percent of the hazardous air pollutants (HAP) in the vent stream were destroyed.

While the system was offline, Valicor continued to operate emission units. This meant that instead of being destroyed, toxic gases were released directly into the Ohio atmosphere. EPA inspectors using FLIR technology also discovered that Tank T118 had an open hatch, allowing hydrocarbon emissions to escape into the ambient air.

The Misconduct: Deception and Decay

The investigation uncovered a pattern of negligence that goes far beyond simple mechanical failure:

The “Lid” Problem: On the DAF Flash Tank, investigators found a 3-inch opening that lacked a closure device. Valicor’s attempt to fix it involved a thin rubber mat with visible gaps. Methane readings near these gaps reached 282 ppm.

The Gauge Lie: Valicor failed to calibrate pressure gauges on a quarterly basis for four years. Furthermore, internal investigations found that in 2017 or 2018, staff had improperly adjusted gauges to show false negative readings, effectively hiding the true state of the facility from regulators.
